We reserve the right, periodically and at any time, to temporarily or permanently modify our services’ functions and features, with or without notice, without liability to you for any interruption, modification, or discontinuation of our services or any function or feature thereof. 

 

You understand and agree that we have no obligation to maintain, support, upgrade, or update the service, or to provide all or any specific content through the Service.

Payments 

We offer our courses for a fee, you agree to pay the fees for courses that you purchase, and you authorize us to charge your debit or credit card or other means of payment for those fees. We work with third-party payment processing partners to offer you the most convenient payment methods and to keep your payment information secure. When you make a purchase, you agree not to use an invalid or unauthorized payment method. If your payment method fails and you still get access to the course you are enrolling in, you agree to pay us the corresponding fees within seven(7) days of notification from us. We reserve the right to disable access to any course for which we have not received adequate payments.

THE SERVICES AND ALL INCLUDED CONTENT ARE PROVIDED ON AN “AS IS” BASIS WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESSED OR IMPLIED. Learnio Albania SPECIFICALLY DISCLAIM ANY AND ALL WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF Learnio Albania OF DEALING OR USAGE OF TRADE. Learnio Albania FURTHER DISCLAIM ANY AND ALL LIABILITY RELATED TO YOUR ACCESS OR USE OF THE THIRD-PARTY SERVICES OR ANY RELATED CONTENT. 

 

YOU ACKNOWLEDGE AND AGREE THAT ANY ACCESS TO OR USE OF THIRD-PARTY SERVICES OR SUCH CONTENT IS AT YOUR OWN RISK. 

Limitation of liability 

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Learnio Albania SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (B) ANY CONDUCT OR CONTENT OF ANY PARTY OTHER THAN THE APPLICABLE Learnio Albania PARTY, INCLUDING WITHOUT LIMITATION, ANY DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR CONTENT OR INFORMATION. IN NO EVENT SHALL Learnio Albania’s AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICES EXCEED TWENTY U.S. DOLLARS ($20) OR THE TOTAL AMOUNT OF FEES RECEIVED BY Learnio Albania FROM YOU FOR THE USE OF PAID SERVICES DURING THE PAST SIX MONTHS, WHICHEVER IS GREATER.

 

YOU ACKNOWLEDGE AND AGREE THAT THE DISCLAIMERS AND LIMITATIONS OF LIABILITY SET FORTH IN THIS TERMS OF USE REFLECT A REASONABLE AND FAIR ALLOCATION OF RISK BETWEEN YOU AND Learnio Albania, AND THAT THESE LIMITATIONS ARE AN ESSENTIAL BASIS TO Learnio Albania’s ABILITY TO MAKE THE SERVICES AVAILABLE TO YOU ON AN ECONOMICALLY FEASIBLE BASIS. 

 

YOU AGREE THAT ANY CAUSE OF ACTION RELATED TO THE SERVICES MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED. 

Indemnification 

You hereby indemnify us to the fullest extent from and against any and/or all liabilities, costs, demands, causes of action, damages and expenses arising in any way related to your breach of any of the provisions of these Terms.

Term and termination 

These Terms will continue to apply to you until the termination of our services, by either you or us. We may terminate the Terms at any time, including in the event of your actual or suspected unauthorized use of our Service or non-compliance with the Terms. If you or we terminate the Terms, will not refund any amounts that you have already paid, to the fullest extent permitted under applicable law.

Severability 

If any provision of these Terms is invalid under any applicable law, such provisions shall be deleted without affecting the remaining provisions herein. 

Governing Law & Jurisdiction 

These Terms will be governed by and interpreted in accordance with the laws of Denmark and you submit to the non-exclusive jurisdiction of the state and federal courts located in Denmark for the resolution of any disputes. 

Changes to the Terms and Conditions 

Occasionally we may, at our discretion, make changes to the Terms and Conditions. When we change the Terms and Conditions that we consider material, we’ll notify you. By continuing to use the website after those changes are made, you express and acknowledge your acceptance of the changes.
